When you have 2 or more layers and one of the layers is selected (I assume that is an indication that it's the active layer and new objects you create will go into that layer) and you deselect the object, even though the layer is hilited in the Layers Panel, when you draw a new shape it will go into the wrong layer. Ok, enough gibberish, here comes the dreaded steps 🙂

      1. Create a new, empty document. By default it will have one layer "Layer 1" in the Layers Panel.
      2. Create a new layer (Layer 2). Now you have Layer 1 and Layer 2.
      3. Select Layer 1 in the Layers Panel, pick a shape and draw it on the artboard. Now your shape shows up in Layer 1 (since that was the active/selected layer).
      4. Control-click the artboard (I'm on the Mac so Control+Click) to deselect the shape you just draw, but notice Layer 1 is still selected/hilited in the Layers Panel.
      5. Draw another shape. Notice the shape went into Layer 2 despite Layer 1 is selected/hilited.
