Deselecting a path made with the path tool does not usually work on first click with command modifier

This might be related to the issue with deselecting nodes with the node tool that was already reported. When I use the pen tool and click off to the side while holding down the command/apple key modifier it does not always deselect - it often takes two or three or more clicks to deselect the path Here is a video of this. sometimes it work but more often it does not.
Using the escape key to end the path does still work correctly

Another thing that might be related, and a behaviour that trips me up is:
- With selected characters, or an insertion point in a text frame.
- Hold Command/Apple key down to get the temporary pointer tool and click empty artboard to deselect.
- Release Command/Apple key and unexpectedly the focus jumps back to to the previously selected characters.
- Have to click the pointer tool then click empty artboard.
The current automatic "reselection after temporary pointer tool use" behaviour works fine if you are wanting to temporarily select a different object to modify it then return to your text, but not if you are using the temporary pointer to deselect.

@Raven I will try to replicate this, seems to be a bug.
